FORFEITURE NOTIFICATION INFORMATION:

If you have been issued a citation for a violation of an ORDINANCE that has been adopted by the City/Town of Lake Mills. This citation carries a monetary penalty and additionally, if the citation is a UNIFORM TRAFFIC CITATION there may be demerit points assessed to your driver’s license. There will be a notation on the face of the citation that will indicate the estimated number of demerit points.

MUST I APPEAR IN COURT?

Look at the upper left hand portion of your citation. If YES is checked, under “Is this a mandatory court appearance?” You must appear in court on the date and time indicated on your citation unless the Court specifically waives that responsibility. In order to receive such a waiver you must contact the Lake Mills Municipal Court office. Failure to appear may result in a warrant being issued for your arrest.

If NO is circled, you have several options you may wish to consider. You must do at least one of the following or sanctions will be taken.

IF YOU WISH TO PLEAD "GUILTY" OR "NO CONTEST"

You do not need to appear on the date on the citation. The court will find you guilty and keep the deposit amount as payment of your citation. Prior to the court date mail the total amount to the Lake Mills Police Department or you may use the pay on-line or by telephone procedure located on the back of this brochure.

IF YOU WISH TO PLEAD "NOT GUILTY"

You may enter a Not Guilty plea to the case by calling the Lake Mills Municipal Court at (920) 648-2344 prior to the court date. Or, you may plead "Not Guilty" by mail .To plead "Not Guilty" by mail send the following to the Court:

  1. Your name and current mailing address and phone number
  2. The charge (traffic violation)
  3. The date you are scheduled to appear
  4. The citation number
  5. Indicate your plea of not guilty

You must mail this information to the Court to the address listed on the front of this brochure. This must be received by the Court no later than the date and time listed on the citation.
If you entered your Not Guilty Plea by phone or mail according to these instructions, the Court will schedule a pretrial conference and send you written notice of the same to your current address as provided above.

Failure to do any of the above may result in your driver’s license being suspended, the issuance of a warrant for your arrest, and/or collecting the money from your income tax refund, and/or turning your account over to a collection agency.

WHAT IF I APPEAR IN COURT?

If you appear in court on the date listed on your citation, you may enter a plea to the charge. You may plead guilty, no contest, or not guilty. This date is not the trial date. If you plead guilty or no contest, the Court will find you guilty and the matter will be resolved at this time.

PRETRIAL CONFERENCE

Upon a plea of "Not Guilty" a pre-trial conference will be held with the Prosecutor for the Lake Mills Municipal Court at the time when you appear in court, or if you enter your not guilty plea ahead of your court date, the pretrial conference will be held on the date and at the time as shown on a notice mailed by the court.

TRIAL

You have the right to a trial. Your trial will be to the Court (a judge).

DO NOT CONTACT THE PROSECUTOR BEFORE YOUR COURT DATE OR PRE-TRIAL CONFERENCE DATE.

CAN I RESCHEDULE A DATE?

You may reschedule your Court date one time as along as you call prior to your Court date.  (920) 648-2344

CAN I GET AN EXTENSION TO PAY ?

Yes, but you must put your request in writing. Explain in a letter why you need the extension, how much time you need, and if you want to be put on a payment plan, and how much you can afford to pay per week or month. This request must be made prior to your fine due date.

DO I NEED AN ATTORNEY?

You are not required to have an attorney for a Municipal Court matter. The decision is yours. Municipal Courts do not provide public defenders.

HOW DO I KNOW IF I'M IN POINT TROUBLE?

If you have any questions regarding your operating or driver’s license and whether you are or will be suspended, including the number of points assessed against your license, please contact the Driver's License Bureau in Madison, Wisconsin at (608) 266-2353.
